FERC issues an Allegheny order, setting aside, in part, the Merger Order by eliminating the one-year notification requirement related to legacy Constellation generators, but otherwise continuing to find that the Transaction, subject to the conditions imposed by the Merger Order, is consistent with the public interest [the Transaction was consummated on Jan 7, 2026; the Merger Order was appealed to and is before the DC Circuit Ct. of Appeals]

FERC approves MOD-032-2 (Data for Power System Modeling and Analysis), IRO-010-6 (Reliability Coordinator Data and Information Specification and Collection), TOP-003-8 (Transmission Operator and Balancing Authority Data and Information Specification and Collection) (RD26-1); MOD-033-3 (Steady-State and Dynamic System Model Validation) (RD26-2); and MOD-026-2 (Verification and Validation of Dynamic Models and Data) (RD26-3)

Cogentrix Public Utilties (which include Nautilus Power and its Related Persons*) request authorization for an transaction pursuant to which an indirect, wholly-owned subsidiary of Vistra (and Related Person to Generation Sector member Dynegy Marketing and Trade) will acquire 100% of the voting equity interests in the Cogentrix Public Utilities, making Nautilus Power and Dynegy Marketing and Trade Related Persons.

*Nautilus Power’s Related Persons include:  Acadia Renewable Energy (which is not part of the 203 application), Essential Power Massachusetts, Essential Power Newington, and Revere Power.
