Waiver Request: Brough Storage Project (Section 5.1.1.2 and Schedule 22 of the Tariff)
FERC issues order denying the request by CleanCapital Holdings and Brough Storage for a shortened comment period on its request for waiver of section 5.1.1.2 of Schedule 22 of the Tariff. Comments on the waiver request are due Oct 29, 2026
Indicated TOs* request an waiver of the ISO-NE Tariff’s Order 881-implementing (Ambient Adjusted Ratings) provisions through Dec 31, 2028, citing delays by unforeseen hardware and software implementation issues (for the same reasons, NYISO and MISO TOs have already received similar waivers of those regions’ Order 881-implementing provisions). The TOs added that, should any of them complete their remaining work ahead of Dec 31, 2028, they will implement the Order 881 OATT requirements at the earliest practicable opportunity, and provide notice to the FERC and ISO-NE at least 30 days prior to doing so.
