ISO-NE requests limited waivers of Market Rule 1 section 13.7.2.6 (Calculation of Capacity Performance Payments) and section 3.3(e) (Late Payment Account) of the Billing Policy so that Brookfield White Pine Hydro’s Harris Hydro Unit 2 is reimbursed/made whole for an approximately $68,000 Performance Payment Charge related to the June 24, 2025 Capacity Scarcity Condition (CSC) for which ISO-NE has determined Harris 2 should not have been charged. As explained in the Waiver Request, ISO-NE manually prevented Harris 2 from running at its EcoMax during the CSC because a non-commercial resource, that was not conducting an otherwise permitted commissioning activity, was incorrectly permitted to run. To rectify the financial consequences of the situation described, ISO-NE proposes the limited waivers so that the June 24 Performance Payment Charge is not reflected as part of Harris 2’s final invoice for that Operating Day and the amount to be returned to Harris 2 off-set by a withdrawal from the Late Payment Account.
